Online Terms and Conditions

Welcome to the cartersfurnitureonline.co.uk website Terms and conditions. These terms and conditions apply to the use of this website. By using or accessing our website and/or placing any orders you agree to be legally bound by these terms and conditions. You should not proceed with your purchase until you have read and agreed to these terms and conditions. These terms relate to internet/telephone sales – showroom sales have a different set of terms and conditions, which are given at the time of order.

Product Specifications

The majority of our products are sold fully assembled, however on occasions certain pieces will need total or minor assembly, this will either be specified in the description of the product, or you will be made aware of this when placing the order. Being a retailer , we do not assemble furniture , however if you were to get in contact with the store by email or telephone , we could give the details of a 3rd party who could quote for assembly of furniture, although , CartersFurnitureonline accepts no responsibility for any problems or issues occuring when using a 3rd party company , and leaves the buyer to make this decision at their own discretion.

We endeavour to display as accurately as possible the colours of our products that appear on the website, however we cannot guarantee the complete accuracy of the pictures or photographs that are shown. Many conditions such as monitor settings and batching can affect the colouring of items in a picture.

All sizes are approximate and are subject to manufacturer and industry tolerances.

Delivery

We are only able to deliver on-line orders to you if you have a permanent address on the UK mainland.

We will endeavour to fulfil your order by the date set out in the e-mail by which we confirmed your order. Where this e-mail did not contain such a date we shall endeavour to fulfil your order within the time-scales advertised on the individual products on your order. All purchases must make allowance of 14 working days from date of dispatch for our carriers to fulfil the final delivery to your home.

You are responsible for providing a safe means of access from the public highway to the place of delivery. If the carriers delivery staff consider that access is unsafe then we will not deliver the goods until safe access is provided. Return charges will apply.

It is your responsibility as a buyer to provide adequate access for furniture into your desired location, and failure to deliver an item of furniture due to inadequate access, will leave the buyer with the responsibility of their goods. If there is no other alternative than to return the items, this will carry a re-stocking fee of a minimum 30% of the original purchase price.

Delivery charges for goods purchased online may be set at a separate rate to goods which are purchased in store and therefore the charges are completely separate and not liable to be interchanged.

For deliveries using our delivery service:

If you are unable, for whatever reason, to take delivery of your goods on the confirmed delivery date arranged, you must inform Cartersfurnitureonline.co.uk at least two working days in advance so that another date can be booked.

For deliveries using a 3rd party carrier:

Should you not be available at the time of attempted delivery you will be left a card and details on so that you can contact the carriers and arrange redelivery yourself. If you do not contact the carrier within 48 hours the furniture will be returned to us. In this instance return charges will apply.

Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of cartersfurnitureonline.co.uk or any reasonable rescheduling of delivery.

If items are received damaged please call us immediately on 01562 755766 and we will rectify the problems as soon as possible.

In the event that you may choose to have your goods delivered to your own 3rd party carrier – we will not accept any responsibility or liability for any damage to your goods. The forwarding delivery is at the risk of the customer when using your own 3rd party carrier.

RETURNS, REFUNDS AND YOUR RIGHT TO CANCEL

In compliance with the Distance Selling Regulations you have a cooling off period where you may withdraw your order and therefore your agreement with us. The cooling off period is any time up to seven working days after the day we have delivered the product to you. You must cancel your order in writing either by fax, letter or email; we must receive this within the 7 day period.

If the goods are returned for any other reasons than being defective then you will be required to arrange and pay for the cost of returning the goods to us. Alternatively we will collect the goods and charge you the direct cost of collection.

The product must be in its delivered form and must not have been tampered with in any way, you are advised to where ever possible use the original packaging to protect the product on its return journey, unless assembled by our own delivery team.

The product will be inspected on return to ensure that the product has not been tampered with and is complete. Please be advised that you do have a duty of care for the products during the period of cancellation of your order and the collection of the goods.

Where a refund is to be paid we will refund any money received from you using the same method originally used by you to pay for your purchase. We will usually process the refund due to you as soon as possible and, in any case within 30 days of the day we received your cancellation instruction.

Deliveries cancelled within 3 working days of confirmed delivery date will incur a cancellation charge of £35.

Bespoke Items or Special Orders

Any products that are special order, bespoke or purchased in bulk are not subject to the cooling off period, we will have commissioned a supplier to make them specifically for you. This will include special order upholstery where a specific fabric and sofa style has been special ordered from a supplier to your order requirements. This also applies to cabinet furniture that is made to order. All orders marked not in stock and have an estimated delivery period of more than 2 weeks imply they are made to order and will be subject to this clause. Should an item which has been ordered be returned by a customer for any reason other than being faulty - they will be held responsible for the cost of collection and the goods will be subject to the company policy of a minimum 30% re-stocking fee. 

Items from Stock

If, after having placed your stock order, you have a change of heart for whatever reason, you may cancel your order at any time prior to delivery. All you need to do is advise us by emailing us at info@cartersfurnitureonline.co.uk

Once we acknowledge receipt of your cancellation, you will receive a full refund using the same method as your original payment.

Cancellation by Carters Furniture

We reserve the right not to accept any order request if:

  • We have insufficient stock to deliver the goods you have ordered
  • We do not deliver to your area
  • One or more of the goods ordered was incorrectly described or priced on the website.
  • The payment transaction is not authorised

If we do cancel your contract we will notify you by email and will refund to you any sum paid by you to us in respect of the contract as soon as possible and in any event within 30 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered

SITE CONTENT AND DISCLAIMERS

Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.

To the maximum extent permissible by laws, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon the information contained on this website.

We aim to constantly improve and develop the brenthamfurniture.co.uk website for the benefit of all our customers, to allow this process to take place, we may occasionally:

  • modify or withdraw, temporarily or permanently, this Website (or any part of it) with or without notice; and/or
  • change the Conditions from time to time, and your continued use of the Website (or any part of it) following such change will demonstrate your acceptance of such change
  • alter or extend promotions at any time.

If Carters Furniture is informed of any inaccuracies in the material on the Site we will attempt to correct them as soon as we reasonably can.

Our total liability in regard to this contract shall be limited to the value of the goods.

Definitions

  • “buyer" means the consumer who buys or agrees to buy goods on this website
  • “goods" means all products listed on the order
  • "consumer" has the meaning given in section 13 unfair contract terms act 1977
  • "Special items" mean any goods that are not held in stock by Carters Furniture and are ordered specifically for the customer.
